These Terms of Service ("Terms") govern your access to and use of the Services provided by Job Capture

Systems ("Company," "we," "us"). By using the Services, you agree to these Terms.

1. Services

We provide marketing operations and automation services, including lead recovery workflows, messaging

automation configuration, reporting, and support as described in your proposal, invoice, or service agreement.

2. No Guarantee of Results

We do not guarantee specific outcomes (including revenue, booked jobs, or conversion rates). Results

depend on factors outside our control such as lead quality, client responsiveness, and market conditions.

3. Client Responsibilities

You agree to provide accurate information, follow messaging compliance rules, honor opt-outs, and respond

to leads in a commercially reasonable time to maximize performance.

4. Messaging & Compliance

If messaging is enabled, you must comply with applicable laws and carrier requirements. Carriers may filter or

block messages; delivery is not guaranteed.

5. Fees & Billing

Fees may include one-time setup fees and monthly recurring fees as stated on your invoice or service

agreement. Third-party platform costs (numbers, usage, CRM, etc.) are your responsibility unless included in

writing.

6. Refunds

Unless otherwise stated in writing, setup fees are non-refundable once work begins, and monthly fees are

non-refundable for the current billing period once charged.

7. Suspension/Termination

We may suspend or terminate services for non-payment, policy violations, or conduct that creates

legal/compliance risk (e.g., high complaint rates, spam behavior).8. Intellectual Property

We retain ownership of our templates, workflows, and know-how. You receive a license to use deliverables

during active service, subject to your agreement.

9. Disclaimers

Services are provided “as is” and “as available.” We disclaim warranties to the maximum extent permitted by

law.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total

liability will not exceed the fees paid to us in the 3 months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your messaging practices, your lead

lists, or your failure to obtain required consent.

12. Governing Law

These Terms are governed by the laws of California.
